International Fellowship in the Qualification and Preparation of Arbitrators in Construction and Building Contracts
The Centre offers this specialized program to prepare and qualify arbitrators in the resolution of disputes arising from construction and engineering contracts in accordance with FIDIC models. The program aims to enable participants to gain an in-depth understanding of the concepts and types of FIDIC contracts, and to understand the legal and procedural frameworks related to the management and implementation of such contracts, including the mechanisms for resolving disputes that arise between the parties of major engineering projects through arbitration. This qualifies them to work as specialized arbitrators in managing construction contracts and resolving the disputes arising from them.
Program Outline:
Foundation Level: Principles and Fundamentals of Engineering Arbitration
• Stage One: Legal skills for establishing the arbitrator
• Stage Two: The concept of arbitration (the agreement and the procedures for managing the case)
• Stage Three: Drafting the arbitral award, enforcement, and annulment
• Stage Four: Contracts and claims in construction contracts
• Stage Five: FIDIC contracts, conditions, claims, and settlements
• Stage Six: The role of technical reports in the arbitral process
Parctical Level: Managing Engineering Arbitration Hearings
• Module One: Introduction to the documents and steps that the tribunal must review before holding the hearings, practically
• Module Two: Practical application of managing procedural arbitration hearings
• Module Three: Practical application of managing hearings for issuing arbitral awards
